Bakwena Wireless Networks Term and Conditons :

Application Contract Terms :

I/we herewith apply for monthly wireless internet service.  I/We acknowledge that termination of this contract is not possible within the first three months and thereafter agree to give one calendar month’s written notice to terminate this contract.  Should I/we fail to pay my/our account I/we shall be liable for any collection, tracing and/or legal fees.  I/we confirm that the above mentioned physical address shall be my/our domicilium citandi et executandi. 
I/We indemnify BWN (Bakwena Wireless Networks) against any damage, loss, claims or cost that may result from work being done in connection with the service being rendered, removal of the service and/or my/our computer equipment not being compatible.  
Use of internet related services is subject to BWN’s Acceptable Use Policy (AUP).  BWN will not be liable for any loss of use, interruption of business, or any indirect, special, incidental, or consequential damages of any kind (including lost profits), regardless of the form of action, whether in contract, direct, or otherwise, even if BWN has been advised of the possibility of such damages. In particular BWN or it’s agents will not be liable for any loss of data due to a software security breach, virus infection or any other form of data loss that can be incurred while connected to the internet or otherwise. 
The applicant consents to the jurisdiction of any competent South African Magistrate’s court for the adjudication of any legal dispute between BWN and the applicant and these terms and conditions will be construed and interpreted in accordance with the law of the Republic of South Africa. 
The applicant acknowledges that the terms and conditions hereof may not be varied or cancelled except in writing and signed by BWN and the applicant.  In the event that any of the terms of this contract are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms, which will continue to be valid and enforceable. 
I/We warrant that I/we have read and accepted BWN’s standard terms and conditions and Acceptable Use Policy (AUP) for online services available on the BWN website

Equipement & Installation Terms:

1. Standard Installation Equipment includes the outside Radio Antenna, Wifi Router,Bracket, Cabling.The cost’s involved in the installation such as travel, installer fee are included within the Installation Fee. The installation of the wireless internet system includes the connection of PC’s or equipment already networked to the LAN (on the day of installation). The wireless installer has sufficient knowledge to connect PC’s to the internet, but IS NOT an IT technician and as such does not do IT maintenance or support.
2. The wireless router included in the installation is sufficient for an average sized home. High power routers or additional equipment to extend the wireless range on larger premises are optional.
3. Please note that there is absolutely no guarantee against lightning on the equipment.  Please take the necessary precaution to avoid lightning damage.
4. Bakwena Wireless Networks only supplies and maintains the wireless internet connections supplied to the customer. Bakwena Wireless DOES NOT supply IT support or maintenance and their responsibility ends with the connection to the customer’s internal equipment(router supplied by ourselves).  Any IT related work has to be attended to by the customer’s IT personnel or IT Support Company.
Packages and payment options:
5. I/We acknowledge that I/we will be charged additional fees for work or maintenance outside the normal equipment warranty required to be done by Bakwena Wireless Networks .  I/We agree that this additional work should be paid on receipt of invoice or alternatively it will be added to the monthly subscription fee.
6. Free telephonic support on the Call Centre and online support on the Website is available 6 days a week from 08h00 to 17h00.  24 Hours support rates can be negotiated separately if required.  On-site support is charged as per Bakwena Wireless Networks Call-Out Fee of R287.50.
7. Bakwena Entertainment and Production Services (PTY)Ltd t/a Bakwena Wireless Networks reserves the right to modify prices on one month’s notice and new pricing will apply to this agreement after the notice period unless the agreement is cancelled in writing by me/us.
8. All internet access packages are uncapped and routed via a high priority fibre backhaul connection with a 1:1 contention ratio.  Our fibre and repeater backhaul links have multiple backup routes with automatic failover ensuring high availability. We DO NOT provide email services.
9. Payment options:
a. New installations and pro-rata subscriptions are payable prior to installation as confirmation of installation appointment.
b. Annually in advance by EFT or direct debit (one month discount applies on annual payments).
c. Monthly in advance by direct debit (Monthly debit orders are compulsory, not optional).
d. A Reconnection fee will be charged on late and unpaid debit orders.
e. Cancellations require one calendar month’s written notice.
f. All prices are VAT exclusive.
